Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of route.wine (the “Service”), operated by Evan Roscoe (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use route.wine
The Service plans visits to wineries and involves content about alcohol. You must be at least 21 years old to use the Service. By using it, you represent that you are 21 or older. We do not sell alcohol, and we do not process payments for alcohol or for any booking made through third-party sites.
2. What route.wine is
The Service provides personalized Napa Valley winery and trip recommendations and itineraries. It is free to use. You can use it anonymously or with an optional account. The Service is informational: we help you plan, but we are not a travel agent, a booking agent, or a party to any reservation, purchase, or transaction you make with a winery, restaurant, activity, or booking platform.
3. Accounts and credentials
An account is optional. To create one you provide an email address and a password, and you may add a display name. You are responsible for keeping your password confidential and for all activity under your account. We store passwords only as a hashed value and never in plain text. We do not currently verify email addresses at sign-up. Notify us promptly if you believe your account has been accessed without your authorization.
4. Acceptable use
You agree not to:
- use the Service if you are under 21, or help anyone under 21 use it;
- break the law or encourage others to do so through the Service;
- scrape, harvest, or bulk-download our content, or use automated means to access the Service beyond normal personal use;
- interfere with, overload, or attempt to gain unauthorized access to the Service or its systems;
- submit content that is unlawful, infringing, defamatory, harassing, or that you do not have the right to submit;
- misrepresent your identity or your affiliation with any person or entity.
5. Your content
The Service lets you create content, including saved trips and trip parameters, personality-quiz answers, visit ratings and notes, a display name, and messages to the concierge (“User Content”). You keep ownership of your User Content.
You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use your User Content for the purpose of operating and improving the Service, including displaying your ratings, notes, and display name in connection with itineraries you save or share. This license is broad enough to cover displaying your display name and content on itineraries you choose to share with others. You are responsible for your User Content and represent that you have the rights needed to submit it.
6. Our intellectual property
The Service, including its software, design, text, compiled listings, scoring, and generated itinerary narratives, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own trip planning. You may not copy, resell, or create derivative works from the Service or its content except as expressly allowed by these Terms.
7. Third-party links and booking platforms
The Service links out to winery, restaurant, and activity websites and to third-party booking platforms such as Commerce7, Tock, CellarPass, OpenTable, and Resy. It also loads map tiles and routing from third-party services. We do not control these third parties and are not responsible for their content, availability, pricing, or practices. Your use of a third-party site or platform is governed by that party’s own terms and privacy policy.
8. Referral and partnership fees
We may earn referral or partnership fees from wineries and tourism partners for bookings that originate from the Service. This does not add any cost to you. We aim to recommend experiences that fit your answers, and referral relationships do not change our commitment to relevant recommendations.
9. Accuracy of listings
Winery hours, prices, availability, and other details are compiled from public sources and may be incomplete or out of date. Confirm details directly with the winery, restaurant, or activity before you visit or rely on them. We are not responsible for changes made by third parties or for reservations that are unavailable, changed, or cancelled.
10. Responsible consumption and driving
Please drink responsibly. Plan a designated driver. The Service plans driving routes between wineries. Do not drink and drive. Alcohol impairs your ability to drive safely, and driving under the influence is illegal and dangerous. You are solely responsible for arranging safe transportation, including a designated driver or a rideshare or car service, and for your own consumption and conduct during any trip you plan with the Service.
11. No warranty
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any recommendation, itinerary, listing, or detail is accurate, complete, or suitable for you.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. This includes anything arising from your visits to wineries, your consumption of alcohol, your transportation, or your dealings with any third party. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred US dollars ($100).
13. Indemnification
You agree to indemnify and hold harmless Evan Roscoe and any employees, contractors, and agents of the Service from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of any law or the rights of any third party.
14. Termination
You may stop using the Service at any time. You can delete saved trips in the app, and you can request account deletion by emailing us. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive, including sections on your content license, our intellectual property, disclaimers, limitation of liability, and indemnification.
15. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
16. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Service after changes take effect means you accept the updated Terms.
